Terms of Service

1. Acceptance of Terms

By accessing or using the Repsalot mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Repsalot ("we," "us," or "our"). We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.

2. Eligibility

You must be at least 13 years old to use this App. If you are under 18, you must have permission from a parent or legal guardian to use the App.

By using the App, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations

3. User Accounts

Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

Account Restrictions

• One account per person
• You may not share your account with others
• You may not create multiple accounts
• You may not impersonate another person or entity

Account Termination

• You may delete your account at any time through the App settings
• We reserve the right to suspend or terminate accounts that violate these Terms
• Upon termination, your right to use the App will immediately cease

4. User Content

Ownership

• You retain ownership of all content you post, including workouts, photos, posts, and comments ("User Content")
• By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content within the App

Content Guidelines

You agree not to post User Content that:

• Is illegal, harmful, threatening, abusive, harassing, or defamatory
• Infringes on intellectual property rights of others
• Contains explicit sexual content or nudity
• Promotes violence, discrimination, or hate speech
• Contains spam, advertising, or promotional material
• Impersonates another person or entity
• Contains viruses or malicious code

Zero Tolerance

There is no place in Repsalot for objectionable content or abusive users. Content or behaviour that breaks these guidelines — including harassment, hate speech, sexual content, threats, and abusive behaviour in chats, comments, clubs or live video battles — may be removed without notice, and the accounts responsible may be suspended or permanently banned.

Reporting and Blocking

• Every post, comment, profile, chat, club post and club comment, and every live battle opponent can be reported from its "..." or flag menu. Content you report is hidden from you straight away.
• You can block any user from their profile, a chat, or a post menu. Blocked users can't follow you, message you, or be matched with you in live battles, and you won't see their content. Reporting a live battle opponent also blocks them.
• You can also write to support@repsalot.com (Help & Support → Report abuse).

Content Moderation

• We review reports within 24 hours. Content that several users report may be hidden automatically until we review it.
• Depending on what we find, we may dismiss the report, remove the content, or suspend or terminate the account responsible.
• We may, but are not obligated to, monitor or review User Content beyond the reports we receive.
• Live video battles are not recorded; we act on reports and an account's history.
• Removal of content does not constitute an admission of liability.

5. Prohibited Activities

You agree not to:

• Use the App for any illegal purpose
• Harass, bully, or threaten other users
• Create fake accounts or impersonate others
• Spam other users with unwanted messages
• Attempt to hack, reverse engineer, or compromise the App's security
• Use automated tools (bots, scrapers) to access the App
• Collect or harvest user data without permission
• Interfere with the proper functioning of the App
• Violate any applicable laws or regulations

6. Health and Fitness Disclaimer

IMPORTANT - PLEASE READ CAREFULLY

Not Medical Advice

• This App is for informational and educational purposes only
• The App does not provide medical advice, diagnosis, or treatment
• The content in the App is not a substitute for professional medical advice
• Always consult with a qualified healthcare provider before starting any fitness program

Use at Your Own Risk

• Exercise and physical activity involve inherent risks
• You assume all risks associated with using the App and following any workout programs
• We are not responsible for any injuries, health problems, or damages resulting from your use of the App

No Warranties

• We make no warranties about the accuracy, completeness, or reliability of fitness information
• Individual results may vary
• Past performance does not guarantee future results

Consult Your Doctor

You should consult your physician or healthcare provider before:

• Starting any new exercise program
• Making significant changes to your diet
• If you have any pre-existing medical conditions
• If you experience pain, dizziness, or discomfort during exercise

7. Intellectual Property

Our Rights

• The App, including its design, features, and content, is owned by Repsalot
• All trademarks, logos, and service marks are our property
• You may not copy, modify, distribute, or create derivative works without our permission

Limited License

• We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes
• This license does not include any resale or commercial use of the App

8. Third-Party Services

The App may contain links to third-party websites or services. We are not responsible for:

• The content or practices of third-party services
• Any damages or losses caused by third-party services
• The privacy policies of third-party services

Your use of third-party services is at your own risk and subject to their terms and conditions.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information. By using the App, you consent to our Privacy Policy.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• WE ARE NOT LIABLE FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL
• OUR TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, WHICHEVER IS GREATER
• SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON LIABILITY, SO THESE LIMITATIONS MAY NOT APPLY TO YOU

11. Indemnification

You agree to indemnify, defend, and hold harmless Repsalot and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your User Content

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY

We do not warrant that:

• The App will be uninterrupted or error-free
• Defects will be corrected
• The App is free of viruses or harmful components
• Results from using the App will meet your expectations

13. Modifications to the App

We reserve the right to:

• Modify, suspend, or discontinue the App at any time
• Change features, functionality, or content
• Impose limits on certain features
• Restrict access to parts of the App

We are not liable for any modifications, suspensions, or discontinuations of the App.

14. Dispute Resolution

Governing Law

These Terms are governed by the laws of the Slovak Republic, without regard to conflict of law principles.

Arbitration

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law.

Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits.

15. Miscellaneous

Entire Agreement

These Terms constitute the entire agreement between you and Repsalot regarding the App.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control.
